    Question Possession with Intent to Deliver in Pennsylvania

    My question involves criminal law for the state of: Pennsylvania

    My boyfriend and i went to blockbuster where he picked up less than 2 ounces of weed from a friend. We left and ended up getting pulled over. The cop said he pulled me over due to air freshner hanging from my rearview mirror and he took our license then came back to the car and asked me to get out of the car. He asked why we were there and i told him to get a movie but they didnt have what we wonted so we left. He then asked me if he could search the car and i said NO. he then called in back up and questioned my boyfriend and made him get out of the car and automatically arrested him. The drug dog came and then my boyfriend admitted the weed was in the car. I still never gave them consent to search and they took the athority to let the dog get in the car. They eventually let me go and took my boyfriend in for questioning. He told them he would work with them so they released him. So they didnt charge him! We came to texas where his family lives and have been staying here for two months and he didnt give any info to the cops. They got him in texas for fines he had from prior and now Pa is wanting to extradite him back. They are charging him with possession with intent to deliver. He waived the extradtion! What is he truely looking at as far as time and do you truely think they are going to extradite him on a faulty pull over? he does have a background but its over 12 years old with no drug history. Will that be taken into cosideration even though its that old?

    Your boyfriend needs an attorney, and he needs one yesterday.

    He's looking at a possible year in jail and a fine of up to $5K.

    He definitly has an attorney so that is a plus. I still think it was a faulty pull over. I mean we were in PA for 3 days and that happens. Wow wrong place wrong time!!

    Let's review.

    They questioned your boyfriend and he admitted to having outstanding warrants. Therefore, his arrest was proper. That also led to probable cause to search.

    The dealer apparently rolled on him.

    wait im not understanding! he never admitted to any outstanding warrants. He was never charged with PWI till after we were already in TX. So i dont see why his attorney told him to lay low and he was okay to come back to TX in the first place. It all is confusing and were running out of time. The 10 days for PA to extradite are already up and TX is completely done with him. Cant he be released?

    this whole situation is confusing and there is alot that hasent come out yet on there side (police) but being pulled over and being told it was because of an airfreshner hanging from my rearview mirror then leading to search and seizure....to me it all sounds fishy! give me my ticket and let me go if that even is against the law to have the airfreshner there i have no clue???

    oh on another note there was suppositly an undercover OFF DUTY cop in the surronding area and he thought he saw something suspicious so if so why didnt they sworm on both the cars instead of just mine? sounds to me as if it was a set up....either way the whole situation in my eyes was completely all done wrong. Neither one of us had are rights read to us at all. Time is ticking so we will see if he is extradited or what the true deal is!
