My question involves criminal law for the state of: Pennsylvania
My boyfriend and i went to blockbuster where he picked up less than 2 ounces of weed from a friend. We left and ended up getting pulled over. The cop said he pulled me over due to air freshner hanging from my rearview mirror and he took our license then came back to the car and asked me to get out of the car. He asked why we were there and i told him to get a movie but they didnt have what we wonted so we left. He then asked me if he could search the car and i said NO. he then called in back up and questioned my boyfriend and made him get out of the car and automatically arrested him. The drug dog came and then my boyfriend admitted the weed was in the car. I still never gave them consent to search and they took the athority to let the dog get in the car. They eventually let me go and took my boyfriend in for questioning. He told them he would work with them so they released him. So they didnt charge him! We came to texas where his family lives and have been staying here for two months and he didnt give any info to the cops. They got him in texas for fines he had from prior and now Pa is wanting to extradite him back. They are charging him with possession with intent to deliver. He waived the extradtion! What is he truely looking at as far as time and do you truely think they are going to extradite him on a faulty pull over? he does have a background but its over 12 years old with no drug history. Will that be taken into cosideration even though its that old?
