    Default Major Construction on High Rise

    My question involves landlord-tenant law in the State of: Illinois

    I have no idea where I should post this, so I probably will put parts of it in the sections I feel it should be in. In Feb of 08 my girlfriend and I had been looking for an apartment to move into in Chicago. We were browsing through craigslist and found an apartment in a high rise that we really liked. We met with the relator and show the apartment. We really liked the apartment and decided to sign a lease. Long story short, our first Morning all we heard was banging and sawing. We had no idea what it was. It started at 7a.m and went all day. We could not relax, study for school, nor could I do my job. I work for Nokia and have conference calls all the time and could not participate in them because of the excessively loud noise. I have two dogs and two cats as well, they would hide most of the time because of the noise. A month later my girlfriend and I had stopped at a local deli to pick up lunch. We can back to eat and watch tv. We could not hear the tv with the volume all the way up. I went down to the lobby to speak with the management of the building. They had told me that the construction was going on for over a year already and would continue to go on for another year. They were surprised that the owner of the apartment had not told my girlfriend and I ahead of time about the construction.

    I became very irritated after I spoke with the management and decided to call the landlord. The landlord could not come up with a reasonably reason why see did not tell us. At first she said she did not know about the construction, while the building management had told me that all owners had been sent letters. Eventually she said she did not think about it when we were discussing the apartment . We told her that we had to move out because we could not study for school, relax and that my job was in jeopardy. In April the landlord said that she would have the relator call me to start showing the apartment. I had asked her if she would have to pay to have the apartment shown again and that I would pay for it. She responded with the realtor gives her a one year guarantee that the tenant will stay. The landlord and I discussed when my girlfriend and I would be moving out. We told her that we would stay through May and move out June 1st. The relator had never called us nor did the landlord about showing the apartment. We had tried calling the landlord several times but never got a returned call.

    June first came around and my girlfriend and I moved out. We left the keys with the building management. July came around and I got a call from a lawyer stating that we broke the lease and that we need to pay for the rent. The lawyer also said that we had damaged the floors in the bedroom. He said that they were buckling because of dog urine. The tenant before us had painted the walls in different colors. The landlord knew this and was happy that we liked the colors so she would not have to repaint the walls before we moved in. The landlord is also suing us for the cost of repainting the walls. We've been going to court since Aug and not have an attribution hearing in April. I have a letter from the previous tenant stating that she had painted the walls. I have a copy of the contract for the construction. I have a letter from my boss about the noise and the affect it had on my job. I also have a work order that was from a year before we moved in. The work order stats that the air conditioning unit had over filled and caused floors to buckle. I also have a work order for alarms to be put in the air conditioning units incase they over fill again. Any advice or direction you guys can point me in would be greatly appreciated.

    Did you and your landlord agree to an early move out? Do you have this in writing? (It always helps to have it in writing!)

    Also, who is suing you? Your landlord, the building management, or the realtor? Are they suing for rent and damages? Did they file for eviction?

    What's an attribution hearing? Do you mean arbitration?

    Sorry to be asking so many questions!
