    Default Examination Under Oath

    My question involves insurance law for the state of: Washington

    Does anyone know where I can get information on my rights as the insured in Washington State.

    I was robbed and had a business in the past. We don't have business insurance because we no longer conduct business. When the adjuster called the following morning my wife answered and the adjuster was simply a jerk and ended up hanging up on her. I requested that we be switched to a new adjuster, but was told that this was not possible because of the recent flooding. He immediately through a red flag on our file, because my wife had some additional quesitons about the business. We know that there's a $5000 cap on our policy for business related items but just needed some clarifiation. We've sent everything that we had including receipts, statements, manuals, pictures the proof of loss etc. A week and a half later we get a letter say that we will need to go to a Examination Under Oath (EUO) because it appears to be some question regarding the possible business use of some of our property. (We never denied having a business). They are saying that this has caused a coverage question in this matter and they're unable to process the claim until the EUO is conducted.

    My questions are:
    What are my rights as the insured?
    Does this sound like they simply need to clarify the business issue or do you think there will be more?
    Can I request my claim file at any time?
    Can they refuse to assign me a new agent at request?
    Are there other options I might suggest to them other then the EUO?

    If I were in your position, I would retain counsel to take along.

    If you refuse to cooperate with an EUO, the insurance company can delay or deny your claim outright.
