My question involves restraining orders in the State of: Maine
My fiancee and I got into a domestic dispute in November of 2008. We were both living in Maine at the time, and I was 5 months pregnant. He was highly intoxicated and unfortunately the police witnessed the worst part of the altercation and had to use extreme force to get him off of me. It was an isolated incident, if he hadn't been so drunk the thought would never have even crossed his mind and never had before. I refused to press charges, so the State did and placed a no contact order between us. I am now about 7 1/2 months pregnant and have been trying to do everything in my power to get this order dropped. I moved back home to New Jersey a few days after the incident, and I know he made bail at the end of this past January only because I had the jail let me know when he did make bail. I've forgiven him for what happened, and had his lawyer file a motion to amend bail to get the order dropped, but the prosecutor opposed it saying it was not in my best interest. The state is very adament about me going through the Victim/Witness Advocate for everything, but personally I don't feel that he is advocating for me. Ever since the state realized that I was not willing to testify against my fiancee they keep me out of the loop and I have to pull teeth to get any information on the case whatsoever. He's facing a felony charge of aggravated assault against a pregnant person, a domestic violence charge and a misdemeanor assault charge. I've told the state that its imperative that this no contact order is dropped so I can speak to him about medical history, insurance costs, financial support, etc, etc pertaining to the baby but they still are standing firm by their decision. Just about anyone I've spoken to about this matter is surprised the order hasn't been dropped yet; I've even told the state that I'm willing to sign a wavier to have it dropped. Is there anything else I can do?? I'm willing to get myself an attorney to have it dropped, anything at all, I just want to have the father of my child back!
