    Default Credit Cards

    My question involves divorce in the State of: Michigan

    Bear with me... I seem to have 10,000 new questions every day.

    I recently learned that I am an authorized user on 3 of my husband's credit cards (we're divorcing... I should be served with papers soon). Initially I was amused, but after checking on the cards, I realized they were all maxed out, and beyond maxed. From what I have read, I'm not responsible for the debt on those cards. I assume I should be able to have my name removed (with or without hassle) from those cards.

    Is there some reason he would be maxing out the cards? It's affecting my credit at the moment, but I'm also worried that it'll mean he'll end up owing less in child support or spousal support if he has a large credit card debt (not to mention 2 car loans... how he ever got those is beyond me).

    Anything else I should be aware of/ warned about concerning this situation?

    Child support is not influenced by his credit card debt or vehicle loans.

    It is not at all affected by his credit debt - the court does not care a whit if you're $10 million in the hole with your credit cards, you pay for your children first, and it will take measures to ensure that you do.

    You can look at a Michigan child support calculator here and the Michigan Child Support Formula Manual to see what factors are taken into account.

    Get your name off those credit cards immediately. Especially since you don't actually have any of the cards in your possession. Document this with your attorney.

    Child Support does not take into account credit card debt. No worries on that one. It is a standard formula they use.
    As far as the credit cards go, you need to have your name removed. With the financial responsibility - this is marital debt. All assets and all liabilities will be split up. You are probably not going to walk away with no marital debt. I know in macomb county it is a 50/50 split. If you haven't been served yet and you have an attorney - why not file your self. At least things will be put in place to protect the marital assets. The longer he waits, the more time he has to go more into debt and so forth.
