My question involves criminal law for the state of: CA

i had a question in regards to going to church during my house arrest period of 60days.

The officer in charge of my house arrest told me that i am ony allowed to go to church once a week and that i am allowed 2 hours including travel time. I usually go twice a week and the services are for 1 hour and 45 minutes so i would not even have time to stay for the entire service sunday given the 2 hour window.

Is this legal for them to do that?

You're argument is one of a 1st Amendment right. There can be conditions for home arrest, such as there are for a person on parole, probation, etc.

Home arrest is restrictive, as it is a confinment, whereas probation and parole involve "freedom of movement".

The conditions set forth in your home arrest agreement apply. IF there is no provision for # of weekly attendances, ask for permission to attend more.
