    Default Home Detention in Florida

    My question involves criminal law for the state of: Florida



    since i am a first time offender and juvenile...do you think home detention for 21 days would be considered a diversion program?

    And if it is, would that mean I can sign a "waiver to a speedy trial" and complete my home detention and have no further action taken against me by the prosecutor correct?

    2nd degree felony for burglary.... but the only thing they have on me is a witness across the street said she saw me and 11 other people go inside but nothing was stolen or damaged and i wasnt at the scene when police arrived

    None of that matters. Read the state law definition of burglary:

    (b) For offenses committed after July 1, 2001, "burglary" means:

    1. Entering a dwelling, a structure, or a conveyance with the intent to commit an offense therein, unless the premises are at the time open to the public or the defendant is licensed or invited to enter
