My question involves collection proceedings in the State of: North Carolina

I am currently on time with a payment with BOA. I pay $360 per month on a debt of 26k. I'm on a reduced payment program where I have 0% interest for 5 years. The plan is really great in theory but my husband and I are in a great deal of debt and recently had a baby. My husband just took a new job that makes half of what he made at his previous job. He was laid off from his previous employer and his unemployment benefits were higher than what his new job pays.

We don't want to file bankruptcy! We just know we're going to reach a place where we can't pay this debt anymore. We've cut costs etc. We have exhausted options.

My question is, (worst case scenario), if we stop paying and end up in court, what will happen? The debt is only in my name. We live in NC (no wage garnishment in this state), and we don't own our home. We have 1 asset, a car, that is worth $1,500. I just want to prepare for the worst.

Those with experience with going to court on a debt are appreciated of a response.
