    Default Filing the I-130

    Hello! I am a US citizen living abroad, and we have completed the adoption of a child in the country where we live. However, due to certain issues we won't be moving back to the US for some time and will eventually file the I-130 form to bring her into the US. What I would like to ask is this - do we have to file that form while residing in the country where she was adopted, or can we file it from any country?

    You don't have to be a resident of the nation where the child was born to file an I-130. Read the instructions (PDF).
