    Question Can the Mother Claim Child Support If I'm the Guardian

    My question involves child support in the State of: califronia

    I have guardianship of my 3 year granddaughter since she was a baby.


    My daughter want to go after the father thru child support.


    My husband got laid off and we lost our house so times are rough..

    I dont want to go after the biological father because he made physical threats.


    I know he as fathered 4 more children ...



    Can my daughter do this? Even though I am guardian.

    Even though we are finacially struggling I dont know if it would be a good idea.

    Am I correct? Your daughter want to seek child support from the father, but he is not the biological father?

    If this correct, what makes him the father? Were they married when the child was born?

    Isn't that immoral to seek money from someone knowing that the child isn't his?

    Just asking...I might have understood your post incorrectly.

    No they were not married.

    Yes my granddaughter is his baby.

    But I have guardianship because my daughter had a drinking problem and depression.

    So now she ( my daughter wants child support)


    Can she do this ?

    Presumably the father will object to her petition by informing the court that the mother doesn't have custody.

    If you are raising and have custody of your grandchild, you should go after both the mother and the father for help for support. Have the court do it. The father doesn't have to find out where you are. Also, file police reports each and everytime he mades a threat.
    Your daughter isn't going to get child support from the baby's daddy if she herself isn't supporting the child!!

    Yes, if you have custody, you have to file, not your daughter.
