    Default Late Fee - No Grace Period

    My question involves landlord-tenant law in the State of: Washington

    Is it legal for a landlord to charge a late fee ($50) if rent is not received prior to 5 PM on the first day of the month...changing what once was a 5 day grace period to a zero day grace period?

    What does the lease say about when rent is due and whether or not there's a grace period before a late fee is assessed?

    We only once signed a one year lease....that was 5 years ago when we first moved in...we've had no written lease since then. Original lease said rent due on 1st with a late fee assessed on rent payments made after the 5th. Verbally, landlord announced change from 5 to 3 days late (a few months ago). Now, landlord says zero days grace period...for us and for the several other rented units on this property.

    How many days notice were you given for the change?

    As a month to month tenant, you no longer enjoy the protections a written lease provides - rather than no changes to the contract for the duration of the contract (in your case, a year), the landlord may now change the agreement on short notice.

    Typically, the notice period is 30 days, and he can change it every 30 days if he wishes.
