    Question Criminal Liability After Turning 17

    Ok i have a bit of a problem so ANY help is useful
    i live in the state of floridia im 17 on feb 14 2009 i was born in 1992 and my gf is 15 turns 16 on July 26 so currently im 16 having sex with a 15yr old that's fine right???
    but in a few days when i turn 17 she will still be 15 does that then make us illegal??
    and what charges could be pressed against me im Australian (all legal i have my green card) am i right to believe i could be charged for statutory rape and have me and my family kick out of the country???
    we have been going out for almost 9 months if that matters.
    This is extremely important to my Any help what so ever is appreciated i dont have much time

    Under Florida statutes, she's totally off limits until she hits 16. So yes, you are already looking at felony charges for what you've already done (up to 5 years in adult prison), just for starters.


    FS 800.04 Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age.--

    (5) LEWD OR LASCIVIOUS MOLESTATION.--

    (a) A person who intentionally touches in a lewd or lascivious manner the breasts, genitals, genital area, or buttocks, or the clothing covering them, of a person less than 16 years of age, or forces or entices a person under 16 years of age to so touch the perpetrator, commits lewd or lascivious molestation.

    (d) An offender less than 18 years of age who commits lewd or lascivious molestation against a victim 12 years of age or older but less than 16 years of age commits a felony of the third degree, punishable as provided in s. 775.082 (5 years in prison), s. 775.083 ($5,000 fine) , or s. 775.084 (enhanced penalties).

    And they can bring a separate charge for EACH time you've committed the crime.

    I don't know anything on this subject. But I'd like to know if said child didn't say anything to anyone, if he could still be in trouble. It seems as though there was consent...

    Minors are unable to give legal consent under the age of 16 in Florida. Even if she BEGGED for it, it is not a defense under the law.

    And, just that easily, you lied.

    No, you didn't have "of course her" consent because, by law, she cannot give it.

    And I find it incredibly hard to believe you looked her mother and father in the eye and said, "I really want to have sex with your daughter, would that be okay?"

    In very plain English: no person under the age of 16 is LEGALLY CAPABLE of giving consent in Florida.

    Parents cannot consent to a crime being committed against their child.

    Children cannot consent to a crime being committed against them.
