    Default Signed birth certificate

    My fiance and I live in Chicago. 4 years ago he had a baby with a girl who lives in Florida. He was 18 years old. He signed the birth certificate assuming that the child was his. When the child was 2 she took him to court and told him she had a restraining order on him and the child was not his. He went and took his part of the paternity test and she never took the child for their half. They then got back together. She has never asked for child support. I have recently made contact with her to get the ball rolling to get a paternity test done. She has agreed but seems to be putting it off. My fiance feels very strongly that this child is not his. But we need to know. Does the fact that he signed the bc hold him legally responsible for this child? Are we able to demand a paternity test? Help!!

    Default Paternity Issues

    If you have access to the child, you can conduct your own DNA test on the basis of a cheek swab. The result is unlikely to be admissible in court, but may resolve your concerns.

    Is it that the child was bornin Florida, and has lived there since birth? Did the prior legal action (supposedly) occur in Florida?

    My fiance and the mother of the child all lived in florida until last year when he came here to Chicago. He has not seen or talked to the child in over a year. My recent contact with her is the first contact we've had. I've contacted a lawyer who is supposed to get back to me today. My fiance's mother has some contact with the child but never without the mother. I really don't want to do anything behind her back. We just really need this matter resolved. We've offered to pay for the whole thing and assured her if he is proven to be the father that he would not try to take him from her. That is what she seems to be most worried about. And yes the prior legal action took place in florida.

    What was the nature of that action? A paternity lawsuit?
