    Default Naming of a Baby in Pennsylvania

    My question involves laws in the State of: Pennsylvania

    I'm unmarried and due to have a baby in a few weeks. I plan to give the baby my last name and am open to giving him the father's last name as a middle name. What rights does the father have for naming the baby?

    Also, when does the Acknowledgement of Paternity get signed? If he does not want a paternity test, can it be done in the hospital and he can be put on the birth certificate then or do we need to file the AOP with the court?

    He can negotiate with you over the name and try to come to an agreement. If you and he can't agree, he can ask a judge to decide the issue either when bringing a paternity action (if he doesn't sign the acknowledgment) or in association with a custody/support/parenting time action.

    If he wishes to acknowledge paternity without first getting a DNA test, he can do so.
