My question involves landlord-tenant law in the State of: Virginia. I moved out of a college apartment in June, our lease ended in July and I have since moved into a new apartment. In October, I recieved a letter saying that I owed $300 (approx.) in addition to the security deposit that they had not given back. I am wondering if this is acceptable considering that in the 4 months it took for them to send this to me, someone else has been living in this apartment. I was under the impression that they had only a certain about of time to fine for damages and once that time period was up, they were out of luck to attempt to collect. They have since sent another letter and I have responded saying that I will not pay because they have not provided what they are fining me for and that when I recieved the fine, someone else has already been occupying that residence. They then threatened to go to court but I have not heard from them since I sent my letter. What should I do? Am I correct in this situation or should I just pay it? Or should I go to court and attempt to win there? Please help!
