    Default Shoplifting at Fry's in Texas

    I was caught shoplifting at Fry's Electronics in Plano, TX. I was told by the security officer that they had video of me shoplifting previously. He said if I brought the merchandise that I took previously (that they have video of) by 11am tomorrow that they would forget about those items. This is my first time caught and the last time caught (I will never ever do this stupid stuff ever again). I stole stupid little things (which doesn't matter stealing is stealing). I'm not sure if even added up with the previous things I took they even add up to $50. My real question is.. Should I take this guy the items I have? or is he going to try and charge me with those as well? Do you think it's a trap?

    Also this is my first offense, I have a ticket and the amount I took that they actually called the cop for was probably about $20 maybe. Can I get a Deferred Adjudication for this? Would also like to get a Non-Disclosure Agreement I believe it's called, to keep it off my record so I can get a job in the future.

    That's anybody's guess. My guess is that he's looking to get you on those items as well. You're smashed up between a rock and a hard place, pal, and we can't help you with that.

    With respect to the actual citation, you need to show up for court, plead Not Guilty, and ask for a Public Defender. You're unlikely to get any sort of leniency otherwise.

    I plan on asking for deferred adjudication and I plan on pleading guilty. There's no sense in pleading not guilty and going with a public defender to defend video of me obviously doing it. I don't deny that I did it. It was a very stupid thing. I will pay whatever fees and do whatever probation or other such punishment they see fit if it comes to that. I don't want to draw this out. I want to get it over with.

    Is it common practice for LP's to ask for the shoplifter to come back and return merchandise that they supposedly have them on camera from before taking? Is that even feesable to think that they still have those camera records?

    So I took back the 3 items. 2 of which I'm pretty sure that I took the 3rd I'm not so sure, it was so many months ago I don't remember. The total of all the items is definitely under $50. I asked the LP if this was going to be added to the civil costs that I will need to pay the store or if he was going to call the police about this as well. he said it was a previous incidence and I asked him again if it was going to just be civil and he said yes. I told him that the items I brought him were all I could remember and that the third thing in the bag I wasn't fully sure about since it was months ago. Anyway, I have a feeling he'll be calling the police for another misdemeanor charge, which would be another Class C Misdemeanor. I'm wondering if that will stack with the other and consider it 2 counts and would make it a class b. I'm sure it will, that is if he goes through with the criminal side, even though he said he wouldn't go that route and just keep these things civil. I can't imagine he's telling the truth. Ah well, see you guys in jail over taking stupid little things impulsively.

    Any idea if they would actually have video of me from 6+ months ago taking the stuff or if they just have a list of known losses and just match the items to the list? I know I'm screwed either way, just curious.

    That ship has sailed.

    Your return of the merchandise stolen is akin to a confession.

    No one is going to go back through 6 months of video.... they just won't.

    As to losses, there are a thousand ways a product can disappear in a store. Shrink is only one.
