    Default Board Members Behind in Assocation Fees

    My question involves a condominium located in the State of: Ga

    Our HOA has half the board members behind in fees of at least 2 months. Our charter states that no board member can be behind. Disqualfied to serve. I requested the President remove them. I think he is behind too. I have gone to a meeting asking each if they were behind they said no comment but I have proof that they are from the managment company. They are not making good decisions money wise and holding the community to the teeth and nail about anything the charter says. They are in office because they would not let people vote who were behind and there were not that many people there. There may be other issues but right now I was told that there is some type of conjunction I can file. I have money but I am in the market for opening a business and do not want it all to go to them. I am spending enough as it is in my time and hoa fees almost 300 a month. Our charter is with the legal system. What document can I file that will be served to them to enforce this rule in our charter. I would like to do this to keep them from messing up further and give me time to investigate other things I suspect that may need a lawyer. Are there attorneys or paralegals that will help with this that are not very expensive?

    First of all you have the right to contact your managment company and ask for a list of people who are behind on their HOA dues.

    Show up with the list to the next HOA meeting and ask to be heard. Present the list and ask for any board member who is behind to either resign or ask for a vote to have them removed.

    You can also make this request to the managment company and they will have to comply

    If you wish to try to find a cheap lawyer, pick up the phone and call until you get a low bid for the work. Note that it's like any other service - you can get lucky, but you're not likely to find that the best are also the cheapest. And you may find that the lawyer who charges less per hour requires a lot more hours of work to get the job done.

    You may yet get your wish. You show up with your lawyer, you proved they are all behind, and they say to you "you got us, we resign".

    One thing you have to remember is not many people want to be bothered to serve on boards, especially the President who has to do all the work, and doesn't get paid. You yourself mentioned few people even attend.

    I recall as a member of my alumni association, I got a letter saying the "entire board is stepping down, to get new blood, because we've been at it for so long". I was dumb enough to show up for the meeting, with almost no members showing up, with all the current board members asking me "please, do you want to be president". Before I can say "let me think about it", I was nominated, seconded and voted in. As I was recovering for the shock, the current board members promised to stay on for the transition.

    Guess what, at the next board meeting, no one showed up, except this one member who came to see what was going on. I took him out for a few drinks.

    I'm wondering if you get them to all step down, do you have a plan to run the place?? Or maybe it's payback time, everyone has a business to go into, and no one is going to pay HOA fees. Or maybe no one has to observe the rules anymore because there is no HOA.

    Have you thought that far ahead?? Did you speak to other condo owners who may want to form a new HOA Board??

    Thanks, I presented the list no one stepped down. They wanted to do payment arrangements. All of them are not behind just the young ones that joined last and want to run everything, fix everything, make money off of everything and know nothing. The rest of the board has been there a long time and they are capable. Its a gang inside of a gang and there are people on the board who could step up and be president etc... I do not have a problem joining. The management gave me a list of those behind but left off a couple on the written response.but gave me a verbal The board said they had a right to privacy and did not want them to disclose if they are behind in their fees. Is there a law that allow you to have this info? What is an injunction? I read you can call your state division of land sales, condos and mobile homes to put in a complaint. Is this true? I would like to move on this as soon as possible before the do major damage. Thanks
