    Question Can Travel Documents Help You Avoid the 10-Year-Ban

    If my illegal immigrant friend is given Travel Documents and subsequently allowed to leave the country, can he apply for a US Visa from his country of origin?

    Also, if the above situation is possible, how long will it be before he can return to the US?

    If he is denied a visa, can his current employer then sponsor him for one?

    By "illegal immigrant" you mean somebody who entered illegally? Somebody who overstayed a visa? Either way, what in the world makes you think they would be eligible for travel documents?

    If your friend leaves the U.S., your friend should expect to serve out his period of ineligibility. If your friend wants to know how he might dig himself out of the immigration hole he has made for himself, he should consult an immigration lawyer. You've told us next to nothing about his situation.

    Ok, my friend's father is a naturalized citizen. I don't know how long ago he became a citizen but his son was already here illegally. Since the father is not petitioning him, can he apply for Travel Documents to leave and then try to get back in legally? He renewed his passport about three years ago, so it's pretty much new and has no visas stamped in there or anything. Would that work?

    Ok Yamz, here is the deal: You apply for travel documents when you are in the process to get a GC. When you do not have the GC yet, but need to go outside. Your friend came in the US and is here illegally (we don't know if he came illegally or came legally and overstayed his visa). If he wants to go out, all ports of entry are open; but once he gets out he is banned for reentry.
    There is not such a thing as being illegal and get a travel documents 2 avoid reentry ban. I do not know where the idea came from.
    The only thing he can pray for is the "Dream Act" to pass.
