    Default College Student Caught Shoplifting in Macy's

    My question involves criminal law for the state of: Virginia

    Law Section: 18.2.96 Petty Larceny (this was on my ticket)


    Hi im 18 and got caught for shoplifting in Macy's today. The total of the merchandise was around $80. I was not arrested the police gave me a ticket and a court date.

    In the past when i was a juvenile (16) I was charged with shoplifting but they let me off with just taking this class and community service and they said it wouldnt go on my record.


    1. What should i do?
    2. What do you think my sentence will be?
    3. Should I get a lawyer?
    4. Is it possible this wont go on my record?
    5. Also does it look better in court to have your parents by your side? Im off at college and need to keep this from knowing this. I know the right thing is to tell them but if they find out I did this again they will be so disappointed and I cant stand to see that again.

    I regret the things i have done in the past. But this has made to come to realize i need to stop this. And i feel awful for doing this. Thank you very much for all of your replies

    DO NOT handle this on your own. Since you are 18 this can really have a bad impact on your future.

    Hire a lawyer to represent you. This site has a link to help you find a qualified attorney in your area.

    You are getting a second chance. The first offense is no longer on your record, so this should show up as your first offense. (Do a background check on yourself to be sure.) You'll probably get just a slap on the wrist, have to pay some money ... but you don't get anymore second chances. You could get jail time for shoplifting, or huge fines. Stop now. The technology they have today is unbeatable. You think they can't see you, but their cameras pick up every little detail. When I was caught, they were able to tell me exactly what I took and exactly where I put it. I was shocked ... I thought I was so good at hiding my actions! Also I agree that you should hire a lawyer because this is a very big deal. Call around and get quotes on the phone. I had one guy quote me $500 and another $1500! Yet their plans were exactly the same.

    I dont agree. There maybe a record of it, disqualifying her for a diversion. A background check will not show her juvie record. The court does have access to it. It just depends on what happened during the first case. Get a lawyer.

    So to answer the questions:
    1. Get a lawyer.
    2. We don't know, depends on how your last case ended. A lawyer will be able to know if you qualify for a diversion or not.
    3. Yes
    4. Not unless you get into a diversion program and complete it with no problems.
    5. This is up to you. Hiding it isn't going to make it better. At least consult with an attorney (criminal defense) to see what your up against, then make a decision as to tell them.

    On a side note...have you ever considered that after you spend all this money for college that you may end up unemployed with lots of debt? Employers don't like to hire thiefs. If you get a second change for a clean record here (totally possible) I hope you realize the impact that this can have on your life. If it came down to 2 job applicants for 1 job....who would u hire, the convicted thief or the one with a clean record?

    I hope this works out for you, and get that lawyer.

    Can they still pull up my juvenile record and see that i have another offense?
    Would it look good to present a letter of apology for Macy's to court?
    What are the chances that I will just have to pay a fine and do community service?

    You need to tell the truth about your record - the court does have access to your prior history.

    It can't hurt to submit a letter of apology. We don't know what your sentence will be - it "might" be a fine & community service.

    You really do need to get a lawyer & ask him all of your questions & to help you with your case.

    This isn't something that you want to play with, that is if your record is important to you. Your out of your league. I strongly urge you to get an attorney. DO NOT for ANY reason, lie to the court. They can pull up your records to the extent that a diverson shows.

    We cant guess as to what will happen to you. Your chances of getting a lesser sentence increase dramatically with an attorney. The money thing may really hurt now, but its a small price to pay for your record to remain clean.

    I would also caution against bringing a confession letter to court unless your lawyer agrees.
