    Default Juvenille Procedure and Testifying Against Son in Juvenile Court PA

    My question involves criminal law for the state of: Pennsylvania

    Hello,

    My son has been charged with burglarly in Pennsylvania.

    He has an adjudication hearing coming soon. My questions are:

    1. If he denies the charges will the judge still rule that day on whether he is delinquent or not. I have researched the Adjudication process procedures and it appears that if he denies the charges the Judge would make the decision of delinquency on that same day but I am not sure.

    2. If the procedure is that the judge does not rule on the day that he denies or confirms the allegations would another hearing be scheduled to determine delinquency? Would that be a trial? by Judge or by Jury?

    3. If a trial is scheduled before a Judge or Jury can I be made to testify for or against my son.

    4. Also with my living in another state and do not have transportation there can testimony be taken by conference call/phone/a notarized statement or something of that matter if I am made to testify?

    That depends upon whether the hearing concludes on that date.

    If the entire hearing is concluded, to the point that a judge can adjudicate on the issue of delinquency, then you've already had your trial. If the upcoming date is a trial date, then trial could start and could conclude on that date.

    If you aren't subpoenaed or instructed to appear in court, and don't appear in court, I doubt that anybody will want to take your testimony.
