    Default Boyfriend Trying to Take Kids

    My question involves a child custody case from the State of: Texas

    The child has not even been born yet, but my girlfriend is starting to get really worried, I just needed some verification or advice on what I should do.

    Her ex boyfriend (who is the father of the child) Is working in conjuction with her mother to attempt to take both the children away (the older one is mine). I have told her that without some sort of proof of phisical or drug abuse or some other factor to prove that she is an unfit mother then they have no chance at all of taking the children away. We are not rich, but we live in a nice neighborhood next door to 2 policemen so we never have to worry about crime. There is always food in the house and the children are well cared for. Currently her ex has no job and is planning on joining the military.

    I owe child support from my first marrage and have been paying it though I was behind a bit when I was between jobs last year. I dont think that would allow the state to take our other children away but I figured it was the only thing that he could have on us.

    He speaks as if he has some big secret up his sleeve that he plans on using against us but I for the life of me cannot figure out what it might be.

    Please tell me if he can take full custody away from her or how we could prevent it. I said before I dont have alot of money so I cant really afford going and getting a lawyer.

    I just need help easing her mind.

    Until the father goes to court and establishes paternity, he can do nothing.

    Her mother has no say in this situation.

    I presume the older child is yours from your previous relationship?

    I cannot emphasize strongly enough what Cyjeff said.

    Unless and until the ex-boyfriend is legally recognized as the father of the child not yet born (and that can't happen til after the child is born), he can't do anything except bluster. Your girlfriend's mother has no say, either.

    And in the case of your child? NEITHER of them have standing to do BUPKISS.

    The main thing she is worried about is after the new baby is born. I know he has rights as a father and we do not want to take those away at all. But what we really want to know is does he have any chance of taking the child away with full custody, even though it is in a good home. We dont do drugs, we love our other child and we always make sure she is taken care of.

    You need to go back and read what we wrote.

    Until paternity is legally established - either by voluntary acknowledgment of paternity or through the courts - he doesn't have any rights. None. Zero.

    Once paternity is established, he may pursue visitation, but that does not mean he will be awarded any custody at all, let alone full custody.
