    Default Using Security Deposit for Rent

    My tenant has broken his 12 month lease and decided to move out. In the lease it clearly states that if you break the conditions of the lease your security deposit will be kept. He gave 30 day notice but did not pay rent for the month of Feb. I know that if you are going thru an eviction process you start with a quite or pay notice but he is moving in 30 days. Is it legal to also use a quite or pay notice if I decide to file judgement against him? , He believes that he can use his security deposit for the last months rent. I know this is illegal in most states but what about Virginia?

    If he has not paid rent then by all means issue the pay rent or quit. If he still fails to pay begin eviction. You do this because once he leaves it can be tough to serve him. You will then have a court date to get your money
