My question involves paternity law for the State of: Mississippi
My brothers ex-girlfriend had a baby a few months ago (he isn't 100% sure he is the father) and when he went to the hospital to see her and the baby her step-dad made a scene by throwing him against the wall and telling him to get out of there. It was made clear to him that she didn't want him involved and she did not name him as the father. They haven't spoken since the baby was born, therefore he hasn't had any contact with the baby at HER request.
He was served papers today from her lawyers requesting child support, dental and health insurance, her legal fees, and NO VISITATION rights or very limited w/ supervision. Apparently paternity is a question, therefore that has to be determined before any legal rights can be assessed. Will the courts demand one? If so, who will pay for it?
If he is the father, what do most judges in Mississippi allow for fathers in this situation? She works at Wal-Mart and he is a maintenance tech. so obviously neither of them have a ton of money or insurance benefits. Is dental something that is commonly required?
He has another child to which he and her mom has an agreement. He does have visitation rights and takes good care of her when he has her. Will they take that into consideration?
