    Question Roommate Trying to Evict by the 7th of Feb

    My question involves a roommate in the State of: Pittsburgh,PA

    I am a college student and will be graduating in May 09.

    My roommate, who is trying to kick me out, is on the lease, while myself and the other roommate are 'witnesses' . I have not spoke to her since October and have simply been ignoring her. She is trying to kick me out because my bf visited for 6 days, and she claims that i did not inform her; also because I've been making 'unnecessary noise' (no specific instances were noted in her letter) for the past three weeks. This is the first I am hearing from either one of them on either of the two issues. I have already paid February's rent and am far too busy to move mid February. Both her and I paid rent late on some occasions, but I always covered my own late fee and rent. I do not owe any money to the company.


    One more thing, I paid my share of the rent for May '08-July'08 and I was not living in the apt during these months, but she was. I was paying my share in order to reserve my space. If she had wanted to, she could have had someone else living here and getting additional rent. I believe this is further proof of a verbal agreement.

    My question is:
    If I do not move by this weekend (7th or 8th of Feb), does she have any legal right to remove my property from the apt?

    I believe I should be served a PROPER (minimum of ) 30 days notice.


    What can I do in this situation?

    There are a few questions here. Do you pay your rent to the roommate or the building owner. That person is your landlord and the only one who has the legal right to evict you.

    Since you don't have a written lease, you are a month to month tenant. PA law requires a full rental period written notice for m2m tenants. Your LL can kick you out with one months notice. If he or she were to give you notice today, it would not take effect until 1 FULL period passed - i.e. end of March.
    LL does not have to specify a reason btw.

    If your roommate locks you out, call the police, and they will force her to let you back in. Additionallyk, police will not enforce a civil move out notice. So even if you were to overstay a properly served notice, the LL would have to file for eviction through the court to physically remove you. He could not simply call the police nor lock you out.

    I would not give your roommate too much info as far as the right way to do things. Let her do her own research. If she confronts you, calmly let her know that you are not moving out until the end of your lease, and call cops if she locks you out.

    Thanks for the reply!

    I've always paid my rent, by check, to the real estate company.

    I spoke to a lawyer over the phone and a legal adviser, all of whom told me essentially what you stated.

    I highly doubt that she even knows that self help evictions are illegal...

    I wrote her a note and posted it on the front door, since I did not want to enter her room and figured she would see it when she locked the door... She crumpled the letter and threw it on the floor...... Really annoying!!
