    Default Will IRS Take Away My 2008 Refund

    Hi to All, My deceased husband owed IRS years after we even got married and doesn't even met him. Last 2007 return, I filed married jointly and showed he was then deceased and all the income on the return was mine and not his. IRS then took away the little amount of $/refund and applied it from my deceased husband's past obligation, but I filed for Injured spouse and eventually got my refund back. Now, I filed for Head of household cuz i have minor kids with me. As I checked today's IRS website re my refund, it says they are processing it and should be on my account on Feb .....(am not going to put the date noted). My ques is that will IRS take it away from me and apply it from my deceased husband's owe? I was thinking No cuz the fact that I filed Head of Household and did not include my deceased husband's name and Social, I think I am safe....

    Were my thoughts correct then?

    It is possible that they have linked your social security number with his and may take your refund again this year. However, as you have done in the past you can dispute this and get the refund back. It is an extra process that you will have to go through, but these things happen.

    If you are filing a return that does not include your husband, then no, the IRS cannot take your refund for past due taxes that were in his name only.
