    Default Personal Opinion of Mental Disorder

    I said that somebody was nuts, and that I thought that they had a personality disorder. I got a call saying they were going to sue me b/c i said she had this disorder.... are they serious?

    I was only giving my opinion, do they have any weight to this?

    Although the law varies by state, opinions won't ordinarily support a defamation action. Presumably you are not a mental health professional, and nobody would believe you were providing a competent diagnosis. However, depending upon your allegations and the manner in which you made your assertion, it remains possible that some form of action would be viable.

    Again, it depends on state law. By way of example, the suggestion that a declaration is made with special knowledge (e.g., of a medical diagnosis) may render an opinion defamatory. We can only guess, as we have no idea what you said.
