Default Damaged Furniture Delivered - Store Won't Pick Up

My question involves a consumer law issue in the State of: TEXAS

I bought a sofa. When it was delivered, the movers damaged the sofa causing a tear in the back as well as scrathes on the wood. The store won't pick it up or credit back my purchase. I have no way to return the sofa myself. I disputed the charges with my bank but the dispute was rejected with the bank stating because I still have the product in my possession. What can I do legally???

Sue them in small claims court for the full amount of the product.

    Will you win?

    I don't have a clue.
