    Question 8 Year Old Summary Offense

    My question involves criminal law for the state of: PA

    8 years ago when i was 19 I plead guilty in a retail theft case. I have a summary offense in retail theft. I was wondering what my chances of being able to get my CNA or LPN and actually getting a job in that area with this offense? I looked into the program for CNA and was told that I can't have a criminal background with a misdemeanor or felony charge, which I don't.

    Also I have been looking into getting the charge expunged, but while looking online is seems it is not likely to get this charge removed. Is this true?

    I have contacted an attorney who I am waiting to get back to me.

    I also wanted to add that I have no other offenses even a clean driving record, seems like that would count for something?

    I am not law savvy but some things I have come across via internet has said that these type crimes (summary offenses) don't show up in background checks if they were done 7 years prior some even said 5 years prior, is this true for Pa?

    Ask the people from whom you want to get the degree if this is a problem.

    I did ask and was told basically it wouldn't effect it since it wasn't a misdemeanor or felony charge, however I don't want to take the course and not be able to get a job in that field because of that charge. She also told me to fill out my application way in advance because if the charge shows up they have to go threw the police dept to get the file, which in the past has proven to take up to 6 weeks to do and she doesn't want me missing the start date of the program when I could have sent my papers in sooner. I have been doing a little internet searches to find out about my chances of getting a job after I take the program and have found that any job working with children WILL deny you because of this charge.
    I don't understand that since I didn't and would NEVER harm a child, I have three wonderful children myself. As I said before I haven't even gotten a traffic violation since.
    Anyways I am wondering what the laws are in reference to expunging ones retail theft charges? is it even likely to get it expunged?

    is there a 5 to 7 year rule that summary offenses are no longer looked at?

    what are my chances of finding a job with my cna or lpn if I can't get this expunged? thank you.

    my attorney called me back I can't get my record expunged until after 10 years for the date the crime was committed, so a little less then 2 years away.

    Anyways i am posting this in case there is another PA person trying to find out information on getting a retail theft record expunged and he/she gets as much information from people on here as I did. thank you to the one person that did respond.
