My question involves a speeding ticket from the State of: Texas
Hello,
I would appreciate any advice with the following. I was issued a ticket for going 45 in a 35 zone. I received a similar ticket a couple of years ago for going 40 in a 30 zone. Some months later, the City raised the speed limit on that road to 40. Also, there are other roadways in the area, with similar design, that are posted at 45, not to mention there is typically nobody on this road at this time of night, though during the day it is busy. My alleged speed was safe and reasonable, as is permitted under State law.
The officer also made a simple mistake of setting the initial appearance date for January of the *previous year.* Nonetheless, it is a technicality. Here is the section of Texas Transportation Code regarding this:
Sec. 543.006. TIME AND PLACE OF APPEARANCE. (a) The time specified in the notice to appear must be at least 10 days after the date of arrest unless the person arrested demands an earlier hearing.
What I have done so far: I showed up on the intended appearance date and entered a not guilty plea, with the option to speak to the prosecutor. I will reread the advice already given on this forum, but would greatly appreciate advice about how to proceed.
Regards
Somewhere in Texas
