My question involves criminal law for the state of: OH
The case: I was picking up a friend from a party and was arrested outside of the party walking in to get him. I was charged with an underage, disorderly conduct and intoxication. The reason the arresting officer gave me an underage was because I said "Officer, you can call my grandma and she'll tell you I was at home watching tv with her before I left without drinking." He replied "Bullshit, you stink like a bar." and I asked to be breathalyzed, he declined to breathalyze me so I said "Well have fun holding this up in court princess."
The prosecutor and I plea-bargained it down to just a M4 Disorderly conduct, it is my first offense. What are my chances of actually seeing any jail time? If there is even one day i'll fight it because based on the circumstances and the twenty three witnesses (my attornee will represent me if it goes to trial but i wan to avoid that) I will 100% for sure be acquitted, I would prefer to get it over with though.
So my question is what is the usual sentencing for a first offense disorderly conduct of the fourth degree in Ohio?
