Is a Wrongful Death Lawsuit Possible

This is regarding a car accident that caused the death of a family man about three years ago.

After the accident the man and the person who hit him exchanged information. That information was given to the family, however the family lost the paper with the information. The information was basically the name of the driver and his licence. The accident was never reported to the police.

In your opinion, how can a lawsuit be filled? Or is this a lost case?

Any accident bad enough to cause the death of one of the drivers would have been reported to the police.

Hard to believe, they would have taken a report at the accident scene itself.

Not to mention that, when discovered, a dead body sitting in a car at an accident scene would have warranted an investigation.

This is a serious inquiry.

Let me clarify, The man did not die at the accident scene. He drove home and hours later he was felling ill that he had to go to the hospital with an ambulance. Internal bleeding was discovered by doctors at the hospital. He never mentioned to doctors that that he was hit by car just a few hours earlier. The man never realized or made the connection that the hit caused his internal bleeding and eventually his death because he was in shock. The at fault driver hit him on the driver's side. The man that died thought he was ok, until hours later where he died at hospital. It was never reported to the police because the man didn't realize the seriousness of the hit at the scene, that caused his death. Both drivers thought it was a minor accident. The driver at fault gave his insurance information to the man to claim compensation for damages he cased to his car. The man never lived to do that.

The effect of the hit was not noticed and realized immediately. There was one passenger who saw the hit. If the family didn't lose the paper with the information on it, this would have been a good case.

First, I would think that most people would have put 2+2 together... I have internal injuries... I have been in a car accident... I don't know why I have internal injuries..

Second, if you don't know who hit them, there is nothing else to do.

You could have filed a claim with the driver's auto insurance...

The man was fine before the hit. So it's clear the hit caused something.
