    Default 1099 Treated As Employee Eligible for Unemployment

    My question involves unemployment benefits for the state of: California

    I was just let go from my job where I was paid as a 1099 for four years due to downsizing. I was let go in the middle of what would have been considered an assignment for completion. After reviewing employee laws, I was actually an employee but it is clear the company wanted to save money on taxes and healthcare costs, etc.

    Am I eligible for unemployment in California due to the length of steady work?

    If not, should I file a claim against the company?

    Any further advice?

    If you are issued a 1099 you are not going to be able to collect unemployment.

    If you were intentionally misclassified as an independent contractor when you were in fact an employee, you can try making a wage complaint and try applying for unemployment. I can't promise what the outcome will be.
