    Unhappy Lent My Car Out. Am I Liable

    I left school for the weekend and told my roommate if an emergency occured, she could use my car. Less than an hour later I got a call saying she had totalled my car rearending someone. She is not covered for that car specifically in insurance but has her own insurance.

    #1 Am I in any way responsible for paying for this situation? I wasn't even in the city or county at the time...

    #2 Will my insurance contact hers or do I have to contact her insurance? Will her insurance blame me for giving her permission to drive in case of emergency?

    Overall I just have no idea what to do, I'm a college student and just need a car.

    Generally, when you let someone use your car, you share the liability for an accident by the borrower.

    You asked if your ins. co. will contact hers - did you report the acc. to your ins. co.? If so, they most likely will contact her ins. co.

    This happened to me last year with my daughter.

    What happened in her case was the borrowers insurance covered the cost of the car that the borrower rear ended and all the expenses for their claims. They would not cover the cost of my daughters car (which was really my car) so to get my car fixed, I had to pay the deductible and get the car fixed. The borrower then reimbursed us the deductible.
    Get on the phone with both insurance companies and ask them how they are going to handle this. They should be able to give you some kind of idea.

    Agree, the ins. companies should work together regarding the liability of each party. Did you report the accident to your ins. co. - I assume you did. The borrower should also have reported it to their ins. co. Your ins. co. should contact them. However, if the borrower didn't report it to their ins. co., you might want to do so as gigirle sugggested. Normally, if you report the accident to your co., they will handle everything with the other co. (if the other person notified their co.) & you don't have to contact the other co. yourself. Your co. should get back to you. What did they say when you called them & reported the accident?
