    Default Fraudulent Marriage

    Need some advice about fraudulent marriage for green card. Here is some background about my situation below:

    I married an illegal immigrant for exactly 2 yrs. and after this person obtained a green card, the ex immediately divorced me. The problem is we have a child together and the ex is sucking the living daylights out of me mentally and financially. Prior to us getting married, the ex dated someone and was illegally paying that person to try to obtain a green card. That person went to jail for about a year, b/c that person was in the business of illegally obtaining green cards. What are my rights? I didn't want it to come this, but we've been divorced for about 3 years now and is seriously killing me in every way possible. I need some help as my rights, child custody, etc.

    I dont understand what the problem/question is. You are divorced. Your ex should not be able to drain you financially. You didn't state what the ex is doing exactly that is causing the problem. Also, if your refering to CS, you didn't say whether your the person paying it or receiving it.

    What I want to do is put the ex through legal proceedings that the marriage was based on fraud. Don't you find it a coincidence that the divorce was immediately after the acceptance of the green card? What can I do legally?

    Sorry about what happened to you. You were obviously one of those victims of marriage fraud. I do not think there is much you can do about this now. At the time u got married, it was a consent between both of u (and a bona fide marriage) and he fufilled the 2 year-condition to get his permanent GC. USCIS kind of sleeps on these kind of situations, unless you have a real tangible proof (like this lady who recorded her ex talking to his real gf on the phone and promissed 2 bring her in the states right after getting his GC); other than that well, you just got screwed. But hopefully he will do something with his life and not be a financial burden on you, b/c legally he is dependent of u for 10 yrs (i do not know if it's possible 2 annul the affidavit of support, but my guess is NO).
    Well, try to talk 2 a lawyer and reduce the mess as much as possible.
