    Default Can Landlord Evict Us Because He Wants to Live in the House

    My question involves landlord-tenant law in the State of: VA

    I have a 2 yr contract with my landlord and he gave me a 30 day notice to move out today. His wife has kicked him out and he wants to live in the house that we are renting. We have looked over our lease and there are no clauses about him selling the house. He is going through a divorce. Can he just make us move or can he sell the house and make us move? We have never been late on the rent and have even did upgrades to the property out of pocket. What are our rights?

    Since you have a lease the landlord must take you to eviction court. He can NOT just order you out of the house.

    You tell the judge your side of the story and let the judge decide. If you do not have any lease violations the court will NOT give the landlord possession of the property.

    If your landlord sells the home, your lease is still valid. The new owner must honor the balance of your lease.

    Thank you for your reply. He gave us a written notice yesturday. Where should we go from here? Do we need an attorney? Do we need to send him a response? We are a nervous wreck and do not know what to do.

    Now after he gave you written notice he needs to follow an eviction in court. You can hire an attorney if you wish, or you can just go infront of the judge and tell him/her that you are not in default. If he serves you with a summons just be sure to show up in court and be prepared to give your side of the story. If it was me , I would not hire a lawyer for this. The choice is yours though.
