    Angry Roommate Wanting to Break Lease

    My question involves a roommate in the State of: Texas

    My roommate has told me she wants to break our lease because she is planning on moving in with her boyfriend. Since she is the one wanting to break the lease, can she be held responsible for the fees it will cost to end the agreement with the apartment complex? I am fine with her breaking our lease but do not feel I should be held financially responsible since this is voluntarily her decision.

    Typically, if two people are on the lease, and one leaves, the remaining person is responsible for full payment of the rent. Unless your lease says you are not held responsible, expect to pay her portion of the rent.

    Paige, legally your roommate is responsible for half the rent until you find a replacement. Talk to her to see if the two of you can get a replacement ligned up by the time she leaves. You have to be reasonable about approving replacements (ie you can't deny people just because you don't know them). The landlord will have to approve the replacement as well.

    Unless the lease provides otherwise (and it's very unlikely), the roommate's responsibility is to the other roommate, and the landlord can demand payment in full even if one roommate isn't contributing to the rent.

    Yes, what aaron said is right, so if she ran out on you, your only recourse would be to pay the LL in full and sue your roommate for half. Try to avoid this situation by arranging a replacement ahead of time.
