My question involves paternity law for the State of New Hampshire.


OKay I need help because calling the court houses and town halls etc, around here gets you no where.

i was married to joe (fake name)in 2003 in 2005 he moved to florida and left me here. nh does not recognize abandonment anymore so I could not file for it. as for divorce i have signed the papers 3 times and had them mailed to him and he always makes an excuse for why he couldn't sign them, anyway, in 2007 i had a son with my new boyfriend. joe was supposed to come to the hospital to sign a denial of paternity affidavit so sean (fake name) could sign the paternity affidavit and be put on my sons birth certificate. but joe never showed.

my son is going to be two years old and i really want to have his father sean on his birth certificate so that in the event that anything would happen to me that joe would not end up with my son, even for a small amount of time. plus this is something that sean really wants.

i talked to DHHS and they told me to file for child support from joe. so i did. i then received a letter stating that it "was not in the best intrest of the child to establish paternity" so there went that idea.

joe seems to think that if we just get the divorce everything will be fine. but i know that he has to DENY that he is my sons father or else we would have to do paternity testing which i really don't want to pay for because WE all KNOW who the father is. there is no doubt.

alot of websites tell me to get a denial of paternity affidavit and have joe sign it. where can i get this. i found one online but i dont want to pay for a form. do i get it at court houses or town halls or what and what does he do with it after he gets it notarized??? and same with the paternity affidavit for sean to sign.


also when filing for the divorce which i am geting the papers for AGAIn only this time i'm doing a single petition. if sean is on my sons birth certificate do i have to file for divorce with minor children or can i do it without...
