    Default Writ of Indigence

    My question involves criminal law for the state of: ohio
    my son owes a fine and cannot find a job .. it is kind of hard for him since they suspended his license, i am not making excuses for his stupidity but i have heard of writs or what ever that he can file to have the fine waived because he is indigent. he lives on his own and has no money, is there laws that prohibit from being jailed for failure to pay fine if poor?

    If I may:

    1. What was he convicted of that resulted in the fine?
    2. How much are we talking about here?
    3. Is he on probation?
    3. If he lives on his own, it's assumed that he's paying rent, utilities; i.e. has some resources to repay. If that is the case, why can't he pay the fine?
    4. Has he attempted to make arrangements, with the courts, to settle this?

    Contrary to popular belief, the courts ARE willing to work with individuals based on their ability to pay. However, the individual who owes must inititate a resolution, not the courts.
