My question involves criminal law for the state of: California
Hi thanks in advance to anyone taking time to reply. I am currently enrolled in the prop 36 program in Sacramento County and about half way finished.Before I started the prop 36 program( or should I say arrested and ordered to enroll in the program) I was in the middle of a case that my attorney kept having continued. So now I have just been sentenced to 120 days ( 59 after all said and done) in Placer county and will need to turn myself in on March 4. My question is this- Will I be in violation for not being able to complete my prop 36 since I will be incarcerated in a another county? I know that if I was arrested after enrolling in the program that they will kick you out and make you do straight time but I have been attending my classes and court appearances and don't want to have to get released from one jail only to be taken to another when I have been complying to all that has been asked of me. Not only that but I will obviously be clean since I will be in jail so I am wondering if they will allow me to continue where I left off? If not I will probably move out of state and if that happens what are statue of limitations on failure to complete prop 36? Thank you very much
