    Default Sentenced to 120 Days in Placer County but Doing Prop 36 in Sacramento

    My question involves criminal law for the state of: California

    Hi thanks in advance to anyone taking time to reply. I am currently enrolled in the prop 36 program in Sacramento County and about half way finished.Before I started the prop 36 program( or should I say arrested and ordered to enroll in the program) I was in the middle of a case that my attorney kept having continued. So now I have just been sentenced to 120 days ( 59 after all said and done) in Placer county and will need to turn myself in on March 4. My question is this- Will I be in violation for not being able to complete my prop 36 since I will be incarcerated in a another county? I know that if I was arrested after enrolling in the program that they will kick you out and make you do straight time but I have been attending my classes and court appearances and don't want to have to get released from one jail only to be taken to another when I have been complying to all that has been asked of me. Not only that but I will obviously be clean since I will be in jail so I am wondering if they will allow me to continue where I left off? If not I will probably move out of state and if that happens what are statue of limitations on failure to complete prop 36? Thank you very much

    I can't help you with your other questions but I believe the statue of limitations applies to filing charges. In other words if you run they'll probably put out a warrant that will remain until you turn yourself in again.

    Have you spoken with your attorney about your concerns? If so, then why would s/he have not explained your current situation to the judge? A judge would not force you to forefit/violate your current program to serve time in accordance to his sentence before your first sentence had been completed. At the very least, your 2nd sentence would run consecutive to the first (one after the other).

    Something just doesn't sound right.

    I know I paid my attorney close to $3,800 only to have him not show up on two occasions and then more or less upset the judge by having my case continued since October. Then the day I was sentenced I thought he wasn't going to show only to have him walk in last minute and say "alright you ready" I was like ready for what we have not discussed what was going to happen or anything I feel like he had other stuff on his mind and I got screwed.

    If I were to move once I was released and not finish my prop 36 if I get pulled over in another state will I be sent back to jail in CA? Thanks again I really appreciate the feedback.
