    Unhappy Chapter 7 -Vs- Divorce, Which Comes First

    My question involves bankruptcy in the state of: Arizona
    My son is considering both and not sure what to proceed with first. His wife is not working, they have 2 children, and their house was just foreclosed. They are living with her parents, but she asked him to leave. He earns less than the state median income with debts around $25K. The only assets are some furniture and a free and clear old SUV. They have already retained an attorney for the bankruptcy, but can't come up with the $3,000 balance owed him to file. Should he proceed with the bankruptcy or file for divorce first?

    Honestly, that's a personal choice. Filing divorce first is not going to make his situation any better. It will however make it a little tougher. When/if he files for divorce, he will be responsible for paying child support and a portion of the childrens' medical expenses and possibly even spousal support.
