    Default Arrested for Possession, but Not Charged After Six Months

    My question involves criminal law for the state of: Minnesota

    I'm 20 years old and have a completely clean record. I was involved in a drug raid. Everyone that had drugs on them was arrested - I had 4 pills of ecstasy in my pocket. 5 of us went to jail, were questioned (mostly about the dealer who wasn't there at the time of the raid) and then were released several hours later. My mother called and was told we were being charged with 5th degree possession of methamphetamines. Upon our release no paperwork or ticket was given.

    It's now been 6 months since the incident and I STILL have yet to receive anything in the mail. I've called several times and my name isn't even in the system.

    My question is: Any ideas what is going on? Could I still be charged? How safe to say is it that I some how received my once in a lifetime get out of jail free card?

    Any advice at this point would be helpful

    Your guess is as good as ours. It could be that there's a delay at the crime lab. It could be that there was an error in processing evidence or paperwork, resulting in delay or a decision not to prosecute. It could be that you'll be charged tomorrow. Unfortunately we can't offer you any certainty. Minnesota has a three year limitations period for misdemeanors, and a longer limitations period for felonies.

    A similar situation happened to an ex-coworker of mine in MN. His apartment was raided and drugs were found (4 ounces of weed). He was arrested and released as you were. Fast forward 6 months and he gets pulled over in Nevada on a road trip and is informed he has a warrant in MN for 5th degree possession. The point is that they might have issued a warrant already without you knowing.

    Ok - well thank you both very much!! I'll periodically call to see if I do have a warrant issued or not. Other then that I guess I'll just have to sit and wait - what a lesson I have learned!!!

    i am living through this in michigan. I am now facing a felony for posession of 6 pills, and i was arrested after being pulled over for speeding. There was a warrant out for my arrest. I posted bond, however mmda is now a class one and is a felony. They have to get the results back from the lab prior to issue of a warrant, it takes some time.
