    Default Do I Qualify for Unemployment Benefits

    My question involves unemployment benefits for the state of: Alabama

    I was hired by a company that stated that my work schedule would be flexible. When I started work with them, I was told that I would have to work between 35 and 40 hours a week, but that I could choose the hours of the day and days of the week to work. It was merchandising work, and did not include direct contact with the general public. The facility that I worked at was fine with any hours that I chose to work, also.
    My question is this:
    The company came into some hard times, and cut the weekly hours down to 16 hours a week. I was fine with that, but THEN they contacted me and told me that I would have to work specific days of the week. I need a flexible schedule because I take care of my disabled father-in-law 4-8 hours a day. I did pick specific days of the week that I would work for them.
    The next day, they contacted me and told me that I needed to work from 10 AM to 2 PM on those days.
    I talked with my supervisor, and HER supervisor-- and asked why they were changing my flexible work schedule into a completely INFLEXIBLE schedule. I was told that all other employees had been working a set schedule--and that they had just "dropped the ball" with me, and that now they needed a set schedule for me.
    I could not commit to a set schedule, and told them that I could work on the days that they needed me to, AND that I could work the 4 hours a day that they needed me for-- but having a set schedule, in my circumstances would not work.
    They fired me, saying that I had committed "Misconduct", even though I had been working the required hours that they needed me, and was completing my work.
    I would not have had a problem with the situation, except for the fact that the job I was hired to do-- was specifically described as a "Flexible Scheduled Job".
    I have filed for Unemployment, been denied, been through 2 appeals, and am approaching my last appeal.
    I have never been fired from a job, nor have I ever been reprimanded for my work. I recently tried to get a job, and was told that they had checked my previous employment record and could not hire me because of it.
    I could care less about the Unemployment payments---I want my work history to show that I am a good employee.
    Is there a way to win this?

    You "may" not get unemployment ins. benefits since you were offered work but turned down the hours/schedule offered.

    All you can do is keep applying for jobs. Good luck.
