My question involves bankruptcy in the state of:Florida,My mortgage company is foreclosing on my home and property and are seeking a final judgement for the total payoff of the home.I have filed head of household and am thinking of bankruptcy. My question is what exactally can they do?
If you file a chapter 7 bankruptcy? the deficiency will be discharged if you meet the criteria of a chapter 7 and the court.

Since Florida is a deficiency state and it is a judicial foreclosure state as well then you will have problems if you do not discharge the debt. The lender can file a deficiency for the shortage after they sell off the home. These days it can be well in excess of $100,000. They can then come after your wages and most other things you own.

It would be best to speak to a bankruptcy attorney ASAP. This site can put you in touch with one in your area.
