Judgments are good for a certain number of years.

The judgment will screw up your credit rating for a long time.

And, also, when you do get some assets, the creditor will come after those assets in order to get their money back from you.

I'm in NY, I had an employee with $200,000 in judgments by dozens of creditors, and currently, there's an employee where I am also under garnishment.

The women with the $200,000 in judgments avoided creditors by:

    - Making less than 30 x minimum wage which comes to about $210.00/week, and thus cannot be garnished under NY law. I had her taken off garnishment as the prior person doing payroll did not know this. I'll get an annual information subpeona from the creditor updating her pay status.

    - She has her car under her sister's name so it won't be seized.

    - She does not maintain bank accounts under her own name.

    - She got $80,000 settlement in a slip and fall accident, and signed the check over to her daughter. Of course, that's a NO NO, but not my obligation to squeal.

    - An employee whose salary is currently garnished uses a "check cashing service" to cash his payments so the money won't go into a bank account that can be seized.

Besides garnishment and seizing bank accounts, cars etc., I done a little research for the women with the $200,000 in judgments and found creditors can seize jewelry (except wedding rings), TV sets (she can keep one), stoves if she has more than one etc. It's all spelled out under NY State law. As far as she told me, no creditor had tried to make an inventory of her personal belongings. But a nasty creditor can make life miserable for you if he wanted to.

Furthermore, she had her husband sign the lease for their apartment, so she can claim everything in the place is his, and also had him make major purchases under his name.

All in all, it's tough dodging creditors, but doable.

What percentage of my monthly salary can be garnished if I can not pay for the total judgement in NY State?

The only asset that I own is a truck that I use to travel to work, is it possible that they can garnish my truck knowning that its needed for my travel?

I went to Civil Court today and sheduled my trial for this summer, what should be my next, should I proceed with VALIDATION NOTICE and a SWORN DENIAL, or this this anything else that i can do before my trail that is to my benefit.

    Thanks
