My question involves paternity law for the State of: Florida.
I was involved and in a relationship with a man for 2 years, I ended up pregnant and on the day I found out I was pregnant I found out he was married. He told me he wants nothing to do with the child. He wasnt to sign off any rights. My son is now 6 months old, I recieved a call about a week ago from his wife telling me that she wants a paternity test and that she believes that if her husband is the father of my son that he should have to support him. While I agree, I told him (the father) that I would never ask him for anything... I have since filed the paperwork for Paternity and child support. Before our son was born he signed a petetion surrendering his rights. I just had him served a week ago with the paperwork. My questions is, Can he now try to come after me for custody? I never planned on lying to my son about where he came from and would be happy for him to know who he father is but am afraid that my son will be in an unsafe enviroment with his wife... How should I proceed? And what is next as far as court goes? I was looking at the answers and I assume he can either admit that he is the father, then we move on to child support or deny it and move on to the paternity test then child support? Please advise.
