    Question Possible Battery or Domestic Violence Charge in Florida

    My question involves criminal law for the state of: Florida

    All right, my boyfriend and his father got into a fistfight on Tuesday night. The polica were called, and my boyfriend was taken to the county jail. I'd like to know first just what exactly the usual process is from that point, because I'm having to find out everything through his family since it's currently a long distance relationship, and I really don't trust them to give me accurate information.

    So first of all I just want to find out the normal process for this kind of thing. Thank you! Sorry if this isn't descriptive enough, I can add more details if needed, I just figured I'd start simple... this is all pretty overwhelming. Also, if it makes a difference, this is the first thing he has ever been arrested for. His father, however, has had the cops called on him numerous times in the past (several times for getting into fights with his son), not to mention he recently had several court dates he went to over some kind of drug test refusal thing--whether or not he actually refused, I don't know. He is under house arrest right now though.

    I was charged with battery in Georgia and the usual process is he will go to a court date in a month of two, which they DA will more than likely offer him some sort of probation and Family Violence classes. If he is smart, he will take it. He would be risking a lot to take it to trial, especially since it is a he said she said type case. Obviously there was enough evidence to arrest and charge so therefore it wont be an easy win, even if the father doesnt want to prosecute. The state will pick it up then. It's not too major of a crime and also depending, he may be able to enter a diversion type program to where if he completes it he will get the charges dismissed in the long run. Good luck to him.

    DV is typically NOT an expungement capable crime.

    Thank you for the replies--I've since found out his court date is February 11th. Do any of you know if he was charged whether or not it would mean he would get denied entry into Canada? Before this happened, we'd been planning for him to come up to visit me and my family and I've gotten different answers from different people on whether this would make it impossible for him to cross the border or not.

    What conditions on travel were included in his bond?
