    Default Final Paycheck After Firing

    My question involves labor and employment law for the state of: California
    When firing a part time employee, is it true that I have to have his final paycheck ready within 72 hours?

    No, you need to pay the terminated employee on your regular payday. So if he is due to be paid on friday, you pay him/her on friday. A fired or current employee is not entitled to any special treatment

    When a final paycheck is due, is a matter of state law. OhMy's answer is partially correct for his state (a FIRED employee in Texas must receive his check within 6 days) but it is not correct in CA.

    Under CA law, if you fire an employee, OR if he gives more than 72 hours notice, his final paycheck has to be ready on his last day of work. If the employee resigns with less than 72 hours notice, then you have 72 hours to pay the final check.
