My question involves labor and employment law for the state of: New Jersey The company I work for states in the employee handbook that full time employees are entitled to 10 paid sick days, two of which can be used as personal days annually. It states that these days may be used for yourself or a family member that you take care of . Recently we were informed that if you call out sick, it is an unexcused absence, you will be paid, but if you accumulate 6 of these unexcused absences in the calendar year, you may be terminated even if you have a doctors excuse. Also the two personal days can only be used after all vacation time is used and they need two weeks notice and it must be approved. The manual states it can be used for personal reasons that may occur. Can they tell you that you are entitled to 10 days, but if you take it, you may be terminated.
