    Default Fired For Unjust Reasons

    My question involves labor and employment law for the state of: Ky.

    I recently made a complaint with the EEOC against my now ex employer. The complaint was in regards to being with the company for a year and 5 fulltime positions became available and I was looked over for each of them. I received my papers in the mail and once signed the employer would get a copy.

    On Jan. 13th 2009 I was given a letter stating I was terminated because my EMT-B certification had expired for Ky. but I am currently National Registered still. The company has always kept up with my certification expiration dates as well as other employees because those are reason for you not to be able to work. Once I was fired I called the EEOC and asked have they sent the paper work to the employer and they said yes we did on Jan. 6th. We were waiting on them to respond back for a Mediation process. Now that I am fired there will be no mediation process.

    I contacted other employees and asked them had this happened to anyone else and they said yes to several employees over the years. One even said that the company let another employee drive a company vehicle along with paid fuel and they were allowed to drive to Frankfort Ky and get recertified due to both of her license expiring. I was fired for the exact same reason the happened to her but she was allowed to continue to work with the assistance of the company getting things straight for them.

    I was wondering can I file suit against this company for these reasons? If so how to I go about getting a lawyer that accepts cases with no retainer and gets paid only If I do? What is the specific name for these types of lawyers.

    You can NOT be discriminated for filing an EEOC complaint, that includes termination. IF you believe you were terminated for such and the reason the company gave was pretextual (false coverup), when and if a future suit is filed, your attorney can claim wrongful discharge also as one causes of action.

    If your suit is based on federal law, EEOC, you need to consult an attorney who handles and or specializes in federal employment/labor law as they will also need to be licensed in federal court, since no doubt the suit will be filed there.

    You need to receive what is known as a "right to sue" letter from the EEOC before suit can be filed.

    A lawyer who is not paid until you win has taken the case on a "contingency" basis. You need to ask what method of payment is applicable if and when you consult him or her.
