    Default 3 Year Old Medical Debt in California

    My question involves collection proceedings in the State of: CA

    Hi, I was in a car accident back in March 2005, and was working with a lawyer on a contingency basis. I went to an orthopedic surgeon back in July 2005 for injuries from the car accident. There I signed a physician - patient arbitration agreement. The physician saw me for a brief period and gave me a piece of paper with different stretches to do. With that said, I recently received a bill in January from a collections agency stating that I owe this orthopedic surgeon $950 + interest - totaling $1300. I have never seen the bill before until the notice. I called the doctor's office and left a message for the billing dept who never called me back. I spoke to the collector who told me that he is going to put my case on dispute to give me time to figure this mess out. I also contacted the lawyer who told me they would have to pull my case out of storage which would take some time. So in the meantime, I was wondering - what are my rights, and how should I proceed with this situation? Am I legally obligated to pay?

    I just wanted to add some more information.

    I called the doctor's office today and spoke with billing. I asked them about the bill and why I haven't received any bills until I received the notice from the collections agency. They claim that they sent the bill to my lawyer who said I wasn't represented with them so they changed their bill to the cash basis (I think that is what she said) and billed me for it. They sent me 3 bills, the first 2 went through and the third one was returned to them. Then I asked them about the bill and how could it be possible for a consultation to cost $950. They said that the fee was for the consultation plus the report they did for my chiropractor and lawyer. I asked them if they can send me my information and she said I would have to contact the collection agency because all the information was forwarded to them.

    Do I have any say in regards to the lawyer completely screwing me over since they told the doctors that I wasn't represented by them at the time of the treatment, when I have a signed letter that they were working with me on the case? Furthermore, I would have not gone to that doctor had the lawyer not told me to have done so since I had medical and could've went to an network provider.
